The National Drought Management Authority (NDMA) is a public body established by the NDMA Act, 2016, with a mandate to coordinate matters relating to drought risk management in Kenya. The Legal Services department is responsible for advising the Board and Management on legal matters, overseeing legal operations, and implementing good corporate governance to enhance organizational credibility. This role ensures the effective and efficient provision of legal advisory services, manages legal and contractual risks, reviews the Authority's enabling legislation, and recommends amendments to support organizational development.
Key Responsibilities
- Oversee the management and administration of Legal Services in NDMA.
- Ensure compliance with rules and regulations affecting NDMA, including the Code of Conduct and Ethics.
- Attend to all legal matters of NDMA, including advising, vetting, and drafting legal agreements related to operations.
- Ensure statutory compliance in the implementation of the Constitution, the NDMA Act, and other relevant laws.
- Carry out legal audits to ensure operations and policies maintain regulatory and statutory compliance.
- Provide and interpret legal information, conduct training, and disseminate legal advisory requirements to staff.
- Give legal advisory services to Management and Staff on internal policies, procedures, and external matters.
- Ensure effective legal representation for NDMA, monitor court cases, and manage external lawyers.
- Review, draw, and vet all service contracts, agreements, leases, and other legal documents.
- Review requests for approvals and licenses for legal soundness and ensure implementation within the law.
- Liaise with the Cabinet Secretary and the Attorney General on the development of rules, regulations, bills, and policies.
- Safeguard NDMA interests before courts, public hearings, arbitrations, and tribunals.
- Ensure all NDMA land is properly registered in the name of the Authority.
- Establish and manage the NDMA Alternative Dispute Resolution Mechanism.
- Provide secretarial services to the Board and its Committees, including guidance on governance duties.
- Facilitate Board induction, development, evaluation, and capacity-building programmes.
- Manage Board work plans, calendars, papers, and the register of Conflict of Interest.
- Maintain custody of the Corporation’s seal, securities, agreements, minutes, and titles.
Job Requirements and Qualifications
- A cumulative period of fifteen (15) years’ relevant work experience, with at least three (3) years at the level of Assistant Director Legal Services or in a comparable position.
- Bachelor of Laws (LLB) Degree from a recognized institution.
- Master’s degree in Law (LLM) or equivalent qualification from a recognized and accredited institution.
- Post-graduate Diploma in Law (Advocates Training Programme) from the Kenya School of Law.
- Valid membership to the Law Society of Kenya (LSK) and an Advocate of the High Court of Kenya in good standing.
- Member of the Institute of Certified Secretaries (Kenya) in good standing.
- Certificate in a Leadership course lasting at least six (6) weeks from a recognized institution.
- Proficiency in computer applications.
- Demonstrated professional competence, managerial, and administrative capability.
- Must fulfill the requirements of Chapter Six of the Constitution of Kenya 2010.
