Reporting to the Assistant Manager - Legal Claims within the SanlamAllianz General Insurance (Kenya) Limited business unit, the Legal Officer is responsible for effectively and efficiently investigating, evaluating, and settling insurance or legal claims. The role ensures legal compliance with regulations such as the Insurance Regulatory Authority (IRA) and Data Protection Act (DPA) while mitigating financial risk. The successful candidate will manage litigated files, analyze merits and quantum, and facilitate cost-effective settlements, supporting lawyers and ensuring adherence to internal policies and statutory requirements.
Role Purpose
The Legal Officer provides technical support, troubleshoots litigation system issues, and evaluates coverage and liability claims. You will interface with insureds, brokers, and lawyers to resolve claims and ensure adherence to internal policies and statutory requirements.
Key Responsibilities
Claim Analysis: Identify valid claims by carefully analyzing supporting documents and ensuring sufficient evidence is provided by the claimant to support the claim.
Negotiations: Conduct negotiations of legal claims to reduce claim costs and prepare detailed file notes.
Fraud Identification: Actively identify fraudulent and suspicious claim activities, reporting them to the Legal Claims Manager.
Litigation Coordination: Coordinate with advocates and witnesses to ensure court attendance for hearing cases and timely conclusion of matters; send out hearing notices where matters are active in Court.
Reporting: Ensure timely submission of Claims Reports and follow up on reports from external counsel, brokers, and agents as per agreed SLAs.
Financial Management: Ensure timely settlement of judgments to avoid execution by auctioneers and minimize further costs.
Legal Research: Conduct extensive legal research and opinion writing on claims settlement relating to employer's liability, Product Liability, and personal auto lines, considering policy wordings and contracts.
Portfolio Monitoring: Prepare monthly reports on outstanding legal matters/files and periodically review pending cases with insureds and agents.
Investigations: Coordinate and conduct investigations into third-party injury/property damage claims to determine validity and adherence to policy terms.
Reserving: Ensure that all assigned legal claims are adequately reserved according to the company’s Reserving policy.
Qualifications and Experience
Bachelor of Laws (LLB) degree from a recognized university.
Postgraduate Diploma in Law from the Kenya School of Law.
Minimum of 2-3 years' relevant legal experience, preferably within the Claims or Legal function of a reputable insurance company.
Demonstrated knowledge of Kenyan legislation, litigation procedures, and dispute resolution mechanisms.
Working knowledge of Insurance Regulatory Authority (IRA) regulations and Association of Kenya Insurers (AKI) guidelines.
Proven ability to conduct legal research, analysis, and interpretation of statutes, regulations, and case law.
Strong written and verbal communication skills, including the ability to draft legal opinions and correspondence.
High level of attention to detail, accuracy, and ability to meet strict deadlines.
Strong organizational skills with the ability to manage multiple priorities effectively.
Professional integrity, reliability, and sound judgment when handling confidential information.
Ability to work independently with minimal supervision while collaborating with internal stakeholders.
