Role Overview
The Deputy Director, Legal Services is responsible for providing leadership in legal advisory services to the Authority and providing Board Secretariat services. This role aims to create a conducive legal environment for the execution of the Authority’s mandate as stipulated in the Kenya Roads Act, 2007.
Key Responsibilities
- Advise the agency and management on legislation affecting KeNHA and any subsequent changes.
- Provide legal guidance on contractual and statutory obligations binding the agency.
- Provide and interpret legal information, conduct training, and disseminate appropriate legal requirements to staff.
- Coordinate the development, implementation, and review of legal policies and procedures to ensure alignment with existing legislation.
- Safeguard the agency’s interests and ensure they are adequately defended before the courts.
- Manage, review, and monitor the progress of all outstanding litigations.
- Issue instructions and liaise with the agency’s appointed advocates to ensure they act in the agency’s interest.
- Ensure the agency complies with constitutional, regulatory, and all relevant laws through legal advisory services.
- Document and maintain records of all enforcement and compliance assignments and develop legal accountability structures.
- Ensure timely compliance with rules and regulations affecting the Agency, including the Code of Conduct and Ethics.
- Review and update all agency codes, regulations, rules, guidelines, and laws for consistency with national and county legal frameworks.
- Develop proactive and preventive legal policies and strategies aimed at forestalling disputes and litigation.
- Provide secretariat services to senior management meetings and ensure decisions are converted to board papers where applicable.
- Develop and vet policy papers and instruments with legal implications for approval.
- Coordinate legal compliance and governance audits.
- Initiate the development of the agency charter and calendar and monitor implementation.
Requirements for Appointment
- Cumulative service period of fifteen (15) years relevant work experience, with at least three (3) years at the grade of Assistant Director, Legal Services or in a comparable position.
- Bachelor of Laws degree (LLB) from a recognized institution.
- Master of Laws degree (LLM) from a recognized institution.
- Post graduate diploma in Law from the Kenya School of Law.
- Admitted as an advocate of the High Court of Kenya with a valid Practicing Certificate.
- Membership to the Law Society of Kenya (LSK) and in good standing.
- Membership to the Institute of Certified Secretaries of Kenya and in good standing.
- Certificate in a Leadership Course lasting not less than four (4) weeks from a recognized institution.
- Proficiency in computer applications.
- Demonstrated professional competence, managerial, and administrative capability.
